Does EVV apply to adult day care?
Short answer
No. Electronic Visit Verification (EVV), the federal requirement created under the 21st Century Cures Act, applies to home-based personal care and home health visits. Congregate and center-based services like adult day care are explicitly outside its scope — and as of this writing, no state has been confirmed to extend EVV requirements to adult day care.

Services delivered at a fixed location — like an adult day center — are explicitly outside federal EVV scope. Adult day is a congregate, center-based service.
The gap this creates
Home care got a mandate. The building didn't.
A home care aide visiting a member's house now has to electronically confirm that the visit happened, because federal law requires it. A member walking into an adult day center for a full day of service doesn't trigger any equivalent federal requirement — because congregate, center-based settings were written out of EVV's scope from the start.
That gap doesn't mean adult day billing gets less scrutiny. New York's MLTC Policy 25.05 already requires managed long-term care plans to collect and retain SADC sign-in/sign-out records with member name, date, and start and end times — and a February 2026 state audit disallowed $672,147 in claims at three centers specifically for inadequate sign-in sheets. The audit risk exists whether or not EVV applies. Only the mandate is missing.

We haven't been able to confirm whether EVV applies to Texas Day Activity and Health Services (DAHS) centers, a congregate adult day program type. Rather than guess, we're saying so directly: if you operate a DAHS center, verify current EVV applicability with the Texas Medicaid program before assuming either answer.
